- General
1.1. The information provided by JOBNET on this Site is believed to be up to date and current at the time of Your use or access of this Site. The correctness, completeness or accuracy of the information is not being claimed.
1.2. We shall not accept any liability arising from the use or access of this Site by the User or any other person, including any loss or damage caused by relying on the information contained on this Site.
1.3. The hyperlinks or external links to any third-party websites on the Site is not an endorsement, affiliation or referral on Our part. JOBNET shall accept no responsibility or liability for the same.
1.4. JOBNET may vary, amend, change and/or update these Terms of Use, from time to time, at its sole discretion, without any prior notice. The User shall be responsible for checking these terms and conditions from time to time, and to ensure continued compliance thereof. The User’s use of the Site after any such change(s) shall be deemed as express acceptance of the changed / updated terms and conditions.
1.5. The User understands and agrees that any translation of these terms and conditions into any other language is solely for the convenience of the User(s), and the English version only shall govern the relationship between the User and JOBNET. Further, in case of any inconsistencies between the English version and any of the translated version(s), the English version shall prevail.
- Acceptance of Terms & Conditions of Use
2.1. These Terms of Use are intended to make the User aware of his/her legal rights and responsibilities with respect to their access to, and use of, this Site.
2.2. By access and use of this Site, the User accepts and agrees to comply with, and be bound by (i) the Terms of Use, (ii) the Disclaimer which the User has accepted and agreed to prior to accessing this Site, (iii) Privacy Policy and (iii) Cookie Policy, as available on this Site.

By using / accessing this Site, the User represents that he/she has read and understood the Terms of Use, thereby concluding a legally binding contract. 2.5. By using or accessing this Site, the User understands that he/she is not entitled to any attorney-client relationship. Further, issuance of our correspondence to our office address or e-mail address, on the basis of information obtained from this Site would not create an attorney-client relationship.
2.6. The User shall make itself aware of the laws applicable to it in relation to any matter described on the Site, and the Use shall be solely responsible for compliance of laws applicable to it.
2.7. In the event any User breaches, or JOBNET reasonably believes that such User has breached these Terms and Conditions of Use, Privacy Policy, etc. or any applicable law, or has illegally or improperly uses this Site, JOBNET may, at its sole and absolute discretion, and without any notice to the User, restrict, suspend or terminate such User’s access to all or any part of Site and/or take technical and legal steps as JOBNET deems necessary.
- Definitions

3.1. Confidential Information shall include (but not limited to) reviews, images, photos, audios, videos, location data, and any / all forms of information or data. The content shall further be categorized as follows:shall mean and include all information of whatever nature relating to Disclosing Party or any of its related entity and any company or business partner and provided to the Receiving Party by Disclosing Party pursuant to this Agreement, which is disclosed in writing andmarked as ‘confidential’ or ‘proprietary’ at the time of disclosure and/or later confirmed in writing to be of confidential nature. Confidential Information shall also include such information which should reasonably understood to be confidential or proprietary by very nature of its disclosure, including but not limited to any information owned or developed by or on behalf of either party.
Confidential Information shall not include information that: (a) is or becomes a matter of general public knowledge other than as a result, of a disclosure made by the Receiving Party or any of its representatives; (b) the Receiving Party establishes by competent evidence, that the Confidential Information was available to it on a non-confidential basis prior to its disclosure to it by the Disclosing Party or its representatives; (c) becomes available to the Receiving Party on a non-confidential basis from a source other than the Disclosing Party or its representatives, provided that such source is not prohibited from disclosing such information to the Receiving Party by any legal, contractual or fiduciary obligation owed to Disclosing Party; or (d) is disclosed with the written approval of Disclosing Party; or (e) is independently developed by the Receiving Party without use of the Confidential Information
3.2. Content shall include (but not limited to) reviews, images, photos, audios, videos, location data, and any / all forms of information or data. The content shall further be categorized as follows:
3.2.1. JOBNET Content means the content that is created by JOBNET and made available in connection with the Our Services including, but not limited to, visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate ratings, reports and other usage related data, in connection with the activities associated with the Users’ accounts, and all other elements and components of service, excluding the User Content and Third Party Content.
3.2.2. Third Party Content means content that comes from parties other than JOBNETor its Users, and is available for service.
3.2.3. User Content means the content that the User uploads, shares or transmits such as profile information, photos, videos, reviews, comments, feedback and/or any other material which is publicly displayed by the User.
3.3. Intellectual Property shall mean and include any and all intellectual propertyincluding but not limited to copy rights, patents, trademarks, permits, service marks, brand names, trade names, trade secrets, source codes, proprietary information, processes, product specifications, product formulations and knowledge technology, computer programs, databases, copyrights licenses, franchises, formulae, designs, proprietary works of authorship, product formulations, designs, colour schemes, etc.
3.4. Terms & Conditions of Use govern the access or use by any person, of the Site, Content and Services made available by JOBNET.
3.5. Use in relation to Content means use, copy, display, distribute, modify, translate, reformat, incorporate into advertisement and other works, analyze, promote, commercialize, create derivative works, and in case of third-party services, allow their users and others to do the same.
3.6. User refers to any person viewing, using and/or accessing this Site, for the purpose of sharing, displaying, hosting, publishing, transacting and/or uploading information, views and/or pictures.
- Intellectual Property Rights
4.1. This Site includes a combination of content created by JOBNET, its partners, affiliates, licensors, associates and/or Users of the services. The Intellectual Property Rights in all software underlying this Site, and the material published on this Site including (but not limited to) software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings, flash animation and trademarks, is owned by JOBNET, its partners, licensors, affiliates and/or associates.
4.2. The User shall not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit and/or utilize any of the materials, information or content on this Site, that does not belong to the User, either in whole or in part, without the express written license from JOBNET and/or the respective third party, to whom such material, information and/or content related to.
4.3. Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise generate and/or make available (“User’s Content”). Each User represents and warrants that he/she owns all Intellectual Property Rights in the User’s Content and that no part of the User’s Content infringes any third-party rights. Users further confirm and undertake to not display or use the names, logos, marks, labels, trademarks, copyrights or any other intellectual and proprietary rights of any third party.
4.4. The User agrees to indemnify and hold harmless JOBNET, its partners, employees, affiliates and assigns against all costs, damages, loss and harm including towards litigation costs and counsel fees, in respect of any third party claims that may be initiated, including for the infringement of Intellectual Property Rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights or any other intellectual and proprietary rights by such User or through the User’s commissions or omissions.
4.5. All names, logos, marks, labels, trademarks, copyrights or any other intellectual and/and proprietary rights belonging to any person (including a User), entity or third party, are recognized as proprietary to the respective owners and any claims, controversies or issues against these names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights must be directly addressed to the respective parties under notice to JOBNET.
4.6. JOBNET reserves the right, at any time and without any prior notice, to remove, block, and/or disable access to any Content, which in its reasonable opinion is objectionable, in violation of its Terms and Conditions of Use and Privacy Policy, illegal, and/or otherwise harmful.
- Confidentiality
5.1. JOBNET will treat all information provided by the user, including User’s Content, date of birth, address, contact information, gender, etc., as confidential. Such information shall not be disclosed by JOBNET under ordinary circumstances, unless such disclosure is required pursuant to an Applicable Law, government requirement or court order; where it is the public interest to do so; and/or where the User has expressly agreed to by the same in writing.
- Investigations:
6.1. JOBNET reserves its rights to investigate complaints or reported violations of the Terms of Use and to any action as may be deemed appropriate and necessary, including but not be limited to reporting any suspected unlawful activity to law enforcement officials, regulators, and/or other third parties. In addition, JOBNET may disclose any information necessary or appropriate to such persons or entities relating to User’s profiles, e-mail addresses, usage history, IP addresses and traffic information. It is clarified that We also reserve Our rights to seek further and other remedies under applicable laws and equity as may be deemed fit.
- Privacy Policy
7.1. All information collected from Users, is subject to Our Privacy Policy.
7.2. The Privacy Policy is to be read as part and parcel of the Terms & Conditions of Use.
7.3. The User has agreed to the Terms & Conditions of Use after reading and understanding the Privacy Policy, and is aware that JOBNET will handle his/her information in accordance therewith. By using any part of the services provided by Us, the User indicates his/her acceptance of the Privacy Policy, and to the collection, use and/or disclosure of his/her personal information in accordance with the Privacy Policy.
- Indemnity & Release and Limitations of Liability
8.1. By using and accessing this Site, the User hereby releases from liability, agrees to indemnify, defend and hold harmless JOBNET and/or any of its partners, employees, affiliates, associates and licensors, from and against any third party claims, and all consequences thereof, including but not limited to personal injury, damage to property (whether direct, indirect, consequential or foreseeable), liability, cost, loss and/or any expense arising on account of the same, as a reason of:
8.1.1. the User’s access and use of the Site; and/or
8.1.2. some act of omission or commission by the User including supply of inaccurate information in relation to the Services
8.2. The User shall be solely responsible for all claims and liabilities or any other consequences, which may arise due to his/her use of the Site, including where such use amounts to violation/contravention of applicable laws, and/or is in non-conformity with the Terms & Conditions of Use, including provision of incorrect address or other personal details. The User also undertakes to indemnify JOBNET (in full) and/or any of its employees, partners, affiliates, associates and licensors with respect to any loss/damage (including legal costs and expenses), which may be suffered by JOBNET on account of such act on the part of the User.
- Disclaimer of Warranties:
9.1. JOBNET does not provide any warranty as to the content of its Site, and the same is distributed on ‘as is, as available’ basis. The User acknowledges that his/ her access to the Site is voluntary and at his/her risk.
9.2. JOBNET does not make warranty or representation that:
9.2.1. The Site will meet the User’s requirement;
9.2.2. The Site Services will be uninterrupted, timely, secure and/or error free;
9.2.3. The results that may be obtained from the use of Our Site will be accurate and reliable; and/or
9.2.4. the quality of any information, or any other material that the User obtains through the Site will meet the User’s expectations.
9.3. To the extent permitted under law, neither JOBNET nor its partners, affiliates, directors, officers, professional advisors, employees shall be responsible for the deletion, the failure to store, the mis-delivery, or the untimely delivery of any information or material.
9.4. The user understands and agrees that the Site shall be used by him/her at his/her own risk, cost and liability. JOBNET shall not be liable to the User or any other person for any loss or damage (either direct, indirect, incidental, consequential, special, exemplary, or punitive) arising out of or in connection with the use / inability to use this Site or the information contained therein; any action take or decision made by the user by relying on the Site or the information contained therein; and/or any unauthorized use or reproduction of the Site and the information contained therein, whether or not JOBNET has been advised of the possibility of such damages. JOBNET does not provide any warranties or guarantees regarding accuracy or effectiveness of the Our Services provided through Our Site.
9.5. JOBNET disclaims any responsibility for any inaccessibility that is caused by maintenance on the servers or the technology that underlies the Site, failures of Our service providers (including telecommunications, hosting, and power providers), computer viruses, natural disasters or other destruction or damage of Our facilities, acts of nature, war, civil disturbance, or any other cause beyond our reasonable control..
9.6. Any material, information and data accessed, downloaded or otherwise obtained through the Site is done at the User’s discretion, competence, acceptance and risk, and the User will be solely responsible for any potential damage to the User’s computer system, computers, devices or loss of data that results from the User’s download of any such material.
9.7. REFUND / CANCELLATION POLICY: We do not provide any refunds or cancellations. All sales shall be final. By booking Our Services, you acknowledge that you understand and agree to this policy.
- Jurisdiction:
10.1. The Site is controlled, operated and maintained in India. JOBNET does not make any representation of warranty that the information and material contained in this Site are appropriate and/or permitted for use in jurisdictions outside India.
10.2. The terms of Use are governed by the laws of India, without giving effect to the principles of conflict of laws and the courts at New Delhi shall have exclusive jurisdiction to entertain all matters arising out of this Terms and Conditions.
10.3. The usage of this Site by the User is subject to the exclusive jurisdiction of the courts located in New Delhi, without prejudice to the rights of JOBNET to take action in any jurisdiction, whatsoever.
